Uh, no charges?

       The Shelby County Reporter has  the story of a man hit and killed by a car in a subdivision roadway in Helena. 
     He was "performing landscaping" in the neighborhood when he was hit and killed.

  

 The 60 year old victim was wearing a leaf blower backpack when he was struck.
     The newspaper story seems to go out of its way to make sure the driver was not doing anything wrong...except hitting and killing a pedestrian, that is.

     (Police) said the driver was not intoxicated "in any way", and said no criminal charges were expected as a result of the accident.
     The exact speed is yet to be determined, "but we don't believe speeding to be a factor in this....it was just a tragic accident."

A story on a local TV station website indicates the driver was "blinded by the sun".

So somebody hits and kills a senior citizen shortly before 4pm on Monday and that's it?
Don't drivers have an obligation, especially in a residential neighborhood, so slow down, especially if they are blinded by the sun? Are we sure there was no texting involved?

[UPDATE: a subsequent story suggests the victim may have stepped back in front of the car. Perhaps he didn't hear it because of the noise form the blower?]
