The governor may be afraid of being on the wrong side of history and being labeled as taking a "schoolhouse door" stance like George Wallace did when he tried to block the integration of the University of Alabama in 1963, Enslen said. But unlike Wallace who was defying an order from the U.S. Supreme Court, Bentley has no such order from that high court, he said.
"Governor Bentley is caving in and giving up our sovereign states rights without a fight," Enslen said.
"Bentley is the chief executive officer of the state and has the sole authority to direct the probate judges in their ministerial duties, Enslen said. Probate judges, for example, get emails every week from the Bentley administration giving directions about car tags, he said."
